01
Agreement and consumer rights
Your rental agreement is between Vibe Rentals Limited (Transport Service Licence 0336743), 31a Sheffield Crescent, Burnside, Christchurch 8053, and the hirer named in the rental agreement. It comprises your booking confirmation, the signed rental service agreement, the vehicle condition report and the version of these terms supplied or linked when you book.
Nothing in these terms excludes or limits rights that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law. If a term conflicts with a non-excludable right, that right prevails.
02
Booking, payment and hire period
- For bookings made more than 30 days before pickup, a 20% deposit confirms the booking and the remaining 80% is due 30 days before pickup.
- Bookings made within 30 days of pickup must be paid in full when confirmed.
- Vibe Rentals will issue or arrange a balance reminder before the due date. If the balance remains unpaid, Vibe Rentals may give a final 48-hour payment notice and then cancel the booking and release the vehicle for rebooking.
- For a booking made through an authorised booking agent, amounts collected by that agent and identified in the booking confirmation are credited against the total booking price. Any remaining balance must be received by Vibe Rentals by the due date shown in the booking confirmation.
- The minimum hire is generally seven days. Any different minimum shown in your booking confirmation applies to that booking.
- Your confirmed pickup and return dates, times and locations form part of the agreement. Extensions require Vibe Rentals' written approval before the scheduled return.
- Early return does not create an automatic refund. Any refund or credit is at Vibe Rentals' discretion, subject to your rights under New Zealand law.
Booking changes
Changes are subject to availability and written approval. A change to the pickup date, return date, vehicle category or location may change the rental price. A change that reduces the number of days or total booking value within 30 days of pickup is treated as a partial cancellation. Moving a booking does not reset the cancellation period; the original pickup date is used when calculating any later cancellation charge.
03
Authorised drivers and licences
Only drivers recorded in the rental agreement may drive the vehicle. All drivers must present a current, full licence suitable for the vehicle. A licence not in English must be accompanied by an approved English translation or International Driving Permit.
Montana and Escapade: 21 years. Aurora and Enigma: 25 years. Additional authorised drivers cost $2 per day.
04
Liability cover and bond options
The cover options, daily cost, bond and damage excess offered for your hire are those shown in the booking system and confirmed in your booking confirmation and rental agreement. Select one option for the full hire period. The bond is a card pre-authorisation unless Vibe Rentals agrees otherwise.
Cover does not apply to an excluded event or amount outside the applicable insurance policy and rental agreement. If website information differs from your confirmed booking, contact Vibe Rentals before payment or collection so it can be corrected.
Bond release
Following a satisfactory return and inspection, Vibe Rentals will request release of the bond pre-authorisation within two business days. Your card issuer may take up to 10 business days to make the funds available. If an issue is identified, Vibe Rentals will notify you and retain only the reasonable amount required while the issue is assessed.
The hirer must provide a valid payment card and authorises Vibe Rentals to charge fines, tolls, cleaning, missing equipment and excluded costs in accordance with the agreement.
Exclusions applying to every option
Cover and excess reductions do not apply where loss, damage or cost arises from an unauthorised or unlicensed driver; alcohol or drugs; illegal, reckless or deliberately unsafe use; a restricted, off-road, beach or flood-water location; incorrect fuel; ignored warning lights; lost or damaged keys; interior damage or personal belongings; failure to report an accident; or unauthorised repairs. Other exclusions in the applicable insurance policy also apply.
05
Using and caring for the vehicle
- Drive lawfully, keep the vehicle locked when unattended and use the correct fuel and fluids.
- Do not drive off formed public roads, on beaches, through flood water or on any road or area Vibe Rentals has identified as restricted.
- Do not tow, race, speed-test, overload, sublet or use the vehicle for illegal activity.
- Stop safely and contact Vibe Rentals immediately if a warning light appears or the vehicle becomes unsafe to drive.
- Dogs are permitted only with prior approval in a designated pet-friendly vehicle. The dog fee is $299 per hire and includes normal post-hire pet cleaning.
- Smoking and vaping are not permitted in the vehicle.
06
Accidents, breakdowns and repairs
Contact Vibe Rentals as soon as it is safe after any accident, damage, theft, breakdown or warning light. Obtain the names, contact details, vehicle registrations and insurer details of involved parties, take photographs and notify Police when required. Do not admit liability.
Mechanical roadside assistance is available 24/7. A callout caused by the hirer, including a flat starter battery, locked-in or lost key, incorrect fuel, empty fuel tank or avoidable tyre issue, may be charged to the hirer.
Do not authorise repairs without Vibe Rentals' prior approval. If immediate action is reasonably necessary to protect people or prevent further damage and Vibe Rentals cannot be reached, take only the minimum necessary step and keep itemised receipts.
07
Return condition and cleaning charges
Return the vehicle on time, with the agreed fuel level, reasonably clean, with the toilet emptied and cleaned, and with all supplied equipment. Fair wear and tear does not include stains, strong odours, excessive dirt, pet contamination, smoke residue or damage.
| Return issue | Charge |
|---|---|
| Excessive interior cleaning | Reasonable cost, up to $250 |
| Toilet not emptied and cleaned | $300 |
| Smoking or vaping | Reasonable cleaning and deodorising, up to $500 |
| Excess pet hair, odour, staining or damage | Reasonable additional cost |
08
Infringements, fines and tolls
The hirer is responsible for traffic, parking, speeding and freedom-camping infringements, tolls and associated lawful costs arising from use of the vehicle during the hire. The hirer authorises Vibe Rentals to provide driver information to an enforcement authority and to charge the payment card where the law and this agreement permit.
- Traffic, parking, speeding or freedom-camping infringement: $50 administration fee per notice, in addition to the infringement amount where Vibe Rentals is required to pay it.
- Unpaid toll: the actual toll plus a $10 administration fee.
- If an unpaid toll escalates to a formal infringement, the $50 infringement administration fee applies instead of the $10 toll fee; both will not be charged for the same matter.
Vibe Rentals will send the hirer copies and notices required by law. The hirer may make representations to the issuing authority and, where available, request a court hearing.
09
Cancellation and no-shows
| Cancellation timing | Charge |
|---|---|
| More than 30 days before pickup | 20% of total booking value |
| 15–30 days before pickup | 50% of total booking value |
| 7–14 days before pickup | 75% of total booking value |
| Less than 7 days before pickup | 100% of total booking value |
| Pickup day or no-show | 100% of total booking value |
Cancellation charges are calculated from the original scheduled pickup date. Amounts already paid are credited against the charge. No refund is payable for late collection, early return or unused rental days. Where a booking was made through an agent, the agent's own booking or payment terms may also apply.
10
Privacy, payment authority and location data
Vibe Rentals collects information needed to quote, book and operate the hire; verify drivers; process payments and bonds; provide roadside support; manage incidents, insurance and infringements; recover amounts owed; and meet legal obligations. Information may be shared with payment providers, insurers, roadside providers, enforcement authorities and professional advisers where reasonably necessary or required by law.
Vibe Rentals will sight identity and licence documents and will retain copies only where reasonably necessary and permitted by law. Full card numbers and security codes should not be written on the rental agreement. Where a vehicle has a location or telematics device, location data may be used for safety, roadside support, theft recovery, fleet management and investigation of a material breach.
You may request access to, or correction of, your personal information by emailing bookings@viberentals.co.nz.
